Terms and Conditions
1.0 Introduction and Acceptance of Terms
1.1. These Terms and Conditions (“Terms”) govern your use of the Sunquest Solar Projects website and the purchase of any products or services offered by Sunquest Solar Projects (Pty) Ltd. 1.2. Sunquest Solar Projects (Pty) Ltd is a private company registered in South Africa, with a primary business address at 150 Rivonia Road Office Park, Morningside, Sandton 2196. 1.3. By accessing this website and/or purchasing products or services, you acknowledge that you have read, understood, and agree to be bound by these Terms. 1.4. Sunquest Solar Projects reserves the right to amend these Terms at any time. The updated Terms will be effective upon posting on this website.
2.0 Products and Services
2.1. Sunquest Solar Projects supplies and installs solar panels, power inverters, backup batteries, and related solar accessories. 2.2. All products are sold subject to availability. Prices and specifications are subject to change without prior notice. 2.3. All solar products are sold with the manufacturer’s warranty. Sunquest Solar Projects will assist with warranty claims but is not the warrantor of the physical product. 2.4. Installation services are provided by highly trained technicians and are subject to a separate, detailed quotation and contract which outlines the scope of work, timelines, and installation warranty. 2.5. Any quotations provided are valid for a period of seven (7) days unless otherwise stated.
3.0 Pricing, Orders, and Payment
3.1. All prices displayed are in South African Rand (ZAR) and are inclusive of Value Added Tax (VAT) unless otherwise indicated. 3.2. Orders placed through the online shop constitute an offer to purchase and are subject to acceptance by Sunquest Solar Projects. 3.3. Payment is required in full before the dispatch of goods or the commencement of installation services, unless otherwise agreed in writing. 3.4. We accept payment via secure online payment gateways and EFT. The risk of loss transfers to the customer upon full payment and/or delivery.
4.0 Delivery, Risk, and Ownership
4.1. Delivery timelines provided are estimates and are not guaranteed, especially in cases of product importation or logistical delays. 4.2. Delivery within Johannesburg and across South Africa is managed by third-party couriers. 4.3. Risk of loss or damage to the product passes to the customer upon delivery of the product to the delivery address specified in the order. 4.4. Ownership of the products remains with Sunquest Solar Projects until full payment has been received and cleared.
5.0 Warranties and Liability
5.1. Sunquest Solar Projects provides an installation warranty separate from the product manufacturer’s warranty. Details of the installation warranty will be specified in your installation contract. 5.2. Our liability for any defect in the installation service is limited to the cost of remedying the defect. 5.3. We shall not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use the products or services. 5.4. Nothing in these Terms limits any rights you may have under the Consumer Protection Act (CPA) of South Africa.
6.0 Governing Law and Dispute Resolution
6.1. These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. 6.2. Any dispute arising from these Terms or the purchase of products/services shall first be attempted to be resolved through good-faith negotiation. 6.3. If a dispute cannot be resolved through negotiation within thirty (30) days, the parties agree to submit to the non-exclusive jurisdiction of the appropriate South African courts.
